Terms of Service

Effective date: July 9, 2026.


1. Acceptance of Terms

By accessing, browsing, or using this website (“Site”) and/or using any products or services (“Services”) offered by BotOfTheSpecter (“Company,” “we,” “us,” or “our”), operating under the business name YourStreamingTools and registered as a subsidiary of LochStudios, Australia Business Number 20 447 022 747, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Site or our Services.

You are responsible for ensuring that your use of the Site and Services is lawful in your jurisdiction. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.


2. Description of Services

BotOfTheSpecter is a streaming operations platform. The Services may include, without limitation:

  • the public website, login/profile pages, and related ecosystem sites;
  • the web dashboard used to configure features, manage media, and control the bot;
  • the Twitch chat bot and related automation features;
  • the Discord extension (designed to work with a linked Twitch channel, not as a standalone Discord-only product);
  • optional Kick companion bot and related webhook features;
  • browser-source overlays and real-time event delivery;
  • API and WebSocket services;
  • optional stream ingest/recording and multi-destination forwarding tools; and
  • integrations with third-party platforms you choose to connect or configure (for example Discord, Spotify, StreamElements, Streamlabs, Patreon, Ko-fi, and Fourthwall).

We offer free features and optional paid premium perks. Premium is currently granted through a third-party platform subscription as described in Section 5. We may update, add, remove, or change features at any time for maintenance, security, legal compliance, capacity, or operational reasons. We do not guarantee that any particular feature will always be available.


3. Eligibility and accounts

You must be able to lawfully use Twitch and any other platforms you connect, and meet any minimum age or other eligibility requirements those platforms impose. You may not use the Services if we have previously suspended or banned your account.

We use Twitch as the login provider (“Sign in with Twitch”). You remain responsible for ensuring that information associated with your account is accurate and kept up to date, including Twitch-linked details we rely on to provide services, communicate with you, and deliver account-related notices.

If your Twitch-linked details change, you may need to log out and log back in so our system picks up the updated information.

You are responsible for all activity that occurs through your account access, including activity performed with API keys, overlay authentication codes, or integration tokens associated with your account. Keep those credentials confidential and revoke or rotate them if compromised.


4. User obligations

4.1 Accurate information

You agree to provide accurate, current, and complete information during any registration, support, or configuration process on the Site or Services.

4.2 Compliance with laws and platform rules

You agree to comply with all applicable laws and regulations regarding your use of the Site and Services, including data protection legislation such as the Australian Privacy Principles and the GDPR where applicable.

You must also ensure that your use of our Services complies with the policies and rules of any third-party platforms you connect to or use in connection with our Services (for example Twitch, Discord, Kick, Spotify, StreamElements, Streamlabs, Patreon, Ko-fi, or Fourthwall), including their community guidelines, terms, and API/platform rules.

Privacy and data protection: Our data handling practices are described in our Privacy Policy. If you use the Site and Services, you agree to use them in a way that is consistent with applicable privacy and data protection laws (including, where applicable, lawful use of personal data and respecting the rights of others). You are responsible for how you configure the bot and integrations in your channel or community, including any collection or display of personal data about your viewers.

Twitch policies: Because we use Twitch as the login provider and our Services interact with the Twitch ecosystem, your use of Twitch is governed by Twitch’s policies, including their Privacy Policy and Terms of Service.

4.3 Prohibited conduct

You agree not to use the Site or Services in any way that is unlawful, harmful, abusive, or interferes with the operation or security of our systems or third parties.

This includes (but is not limited to) agreeing not to:

  • disrupt or interfere with the Site or Services, or attempt to bypass or defeat security or authentication measures;
  • attempt unauthorised access to accounts, systems, data, or networks;
  • use automated systems in a way that imposes an unreasonable load, scrapes, or otherwise abuses the Site, API, WebSocket services, or other Services;
  • share, sell, or publicly expose API keys, overlay authentication codes, OAuth tokens, or other credentials that grant access to your account or channel configuration;
  • upload, transmit, or distribute malware, harmful code, or content that is intended to harm systems or users;
  • engage in fraudulent activity, misrepresentation, or any attempt to exploit subscription or entitlement systems;
  • use our Services to facilitate spam activity on Twitch or other platforms, including configuring the bot to spam your own channel via automated messaging;
  • use the Services to harass, defame, threaten, or unlawfully collect personal information about others;
  • misuse stream recording/ingest or forward features, including attempting to record or redistribute content you do not have rights to process; or
  • reverse engineer, decompile, or attempt to extract source code from non-open components except to the extent permitted by law or an applicable open-source licence.

Abuse and enforcement: configuring the bot to spam (including via auto messages) and then reporting the bot, or otherwise attempting to misuse reporting/enforcement processes, may result in your profile/account being restricted or banned on our system and access removed at the discretion of YourStreamingTools.

4.4 Your content and configuration

You retain ownership of content you submit (for example custom command text, media uploads, and channel-specific configuration). You grant us a limited licence to host, process, transmit, and display that content solely as needed to operate the Services you enable.

You represent that you have the rights needed to upload media, connect integrations, and process the data involved in your use of the Services. You are solely responsible for the legality of your configurations and the content shown to your audience.


5. Payment terms and Premium

Current Premium model: BotOfTheSpecter Premium features/perks are currently unlocked by an active Twitch subscription to the bot developer Lachlan (gfaUnDead, https://twitch.tv/gfaundead / subscribe at https://www.twitch.tv/subs/gfaundead). Payment for that subscription is handled by Twitch under Twitch’s billing terms. We do not process card payments for Premium inside the BotOfTheSpecter application.

Premium eligibility and changes: Premium perks are contingent on an active subscription status as recognised by Twitch (or on an internal beta-access grant we may issue). If your subscription ends, expires, is cancelled, is refunded/charged back, or otherwise becomes inactive, premium perks may be removed. We may update the specific premium perks over time. Specific feature gates and storage limits are described in the dashboard Premium pages and may change.

Refunds: Because Premium is billed by Twitch, refund requests for Twitch subscriptions are governed by Twitch’s policies and support processes, not by a separate BotOfTheSpecter checkout. For questions about Premium entitlement after a Twitch billing issue, contact us via the support portal or the contact addresses below and we will help investigate access on our side where possible.

Future paid products: If we introduce other paid products billed by us or by a third-party billing provider, we will disclose the provider and applicable terms at the point of purchase and update these Terms as needed.


6. Third-party services and integrations

The Services may interoperate with third-party platforms and products. Those services are not under our control. Your relationship with each third party is governed by that party’s terms and privacy policy. We are not responsible for third-party outages, policy changes, API limits, content, or decisions (including account actions taken by those platforms).

Features that depend on a third-party connection may stop working if you revoke access, if tokens expire and cannot be refreshed, or if the third party changes or withdraws its API.


7. Privacy

Your privacy matters. Please review our Privacy Policy for details about data collection, use, protection, international processing, and how to export your data (including via the automated Export my Data feature on the dashboard profile page). For privacy-related requests, contact gdpr@yourstreamingtools.com.

We use Twitch as our login provider (“Sign in with Twitch”). Your use of Twitch is governed by Twitch’s policies, including their Privacy Policy and Terms of Service.

If you request a data export, the delivery method and availability window are described in our Privacy Policy.


8. Intellectual property

All Site content (including text, graphics, logos, images, and software we provide) is owned by BotOfTheSpecter, YourStreamingTools and/or LochStudios (or our licensors) and is protected by applicable intellectual property laws and copyright.

Portions of BotOfTheSpecter may be available under open-source licences on our public repositories. Where open-source licences apply, those licence terms govern the licensed materials. Except as expressly permitted by us in writing or by an applicable open-source licence, you must not copy, reproduce, modify, republish, upload, transmit, distribute, sell, license, or create derivative works from any part of the Site or Services.

All trademarks, service marks, and logos used on the Site are the property of their respective owners. Nothing in these Terms grants you any right to use our names, branding, or logos without our prior written consent.

This website and the Services are not affiliated with or endorsed by Twitch Interactive, Inc., Discord Inc., Spotify AB, Live Momentum Ltd., StreamElements Inc., Kick Streaming Pty Ltd, OpenAI, L.P., or other third-party platforms named for identification. All trademarks, logos, and brand names including Twitch, Discord, Spotify, StreamElements, Kick, and related marks are the property of their respective owners and are used for identification purposes only.


9. Availability and modifications

We aim to keep the Services available, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, platform API changes, capacity limits, and force majeure events may affect availability.

We may modify, suspend, or discontinue any part of the Services at any time. Where practical, we will provide notice of material feature removals, but we are not obligated to maintain any particular feature indefinitely.


10. Termination

We may suspend, restrict, or terminate your access to the Site and Services at our discretion for violations of these Terms, security reasons, or to prevent spam, abuse, fraud, or other prohibited activity.

We may also suspend or terminate access where required by law or where doing so is necessary to protect our users, our systems, or third parties.

You may stop using the Services at any time. Disconnecting integrations or closing related platform accounts may limit or end functionality that depends on those connections. Ending a Twitch subscription to gfaUnDead may remove Premium perks as described in Section 5.

Upon termination or restriction, you may lose access to features, settings, media, and entitlements associated with your account. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.


11. Disclaimer of warranties

The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.

To the maximum extent permitted by law, we disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that data will never be lost.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under Australian Consumer Law or other applicable law.


12. Limitation of liability

To the maximum extent permitted by law, BotOfTheSpecter, YourStreamingTools, and LochStudios will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site or Services, even if advised of the possibility.

Where liability cannot be excluded but can be limited, our aggregate liability for claims arising out of or relating to the Services is limited to AUD $100, except where a higher minimum non-excludable liability applies by law.

Nothing in these Terms limits liability to the extent it cannot be limited under applicable law (including liability for fraud, or death or personal injury caused by negligence, where such limitations are prohibited).


13. Indemnification

You agree to indemnify and hold harmless BotOfTheSpecter, YourStreamingTools, LochStudios, and their affiliates, officers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to your use of the Site or Services, your content or configurations, your violation of these Terms, or your violation of any law or third-party rights.


14. Changes to terms

We may modify these Terms from time to time to reflect changes to our services, business practices, legal requirements, or for other operational reasons.

When we make changes, we will post the updated Terms on the Site and update the “Effective date” above. Unless stated otherwise, changes take effect when they are posted.

If we make material changes, we may provide additional notice where appropriate (for example, by displaying a notice on the Site or contacting you via an email address associated with your account). Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.


15. Governing law

These Terms are governed by the laws of Australia (and, where applicable, the state or territory in which LochStudios operates), without regard to conflict of law principles that would require application of another jurisdiction’s laws.

You agree to submit to the non-exclusive jurisdiction of the courts located in Australia for the resolution of disputes arising out of or relating to these Terms, to the extent permitted by law.


16. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Privacy Policy and any feature-specific notices we provide, form the entire agreement between you and us regarding the Services and supersede prior agreements on that subject.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a reorganisation, merger, or sale of assets.
